SC: Unjustified Absence From Marital Home Considered Psychological Incapacity

In Leonora Dela Cruz-Lanuza v. Alfredo Lanuza, Jr., a decision penned by Justice Leonen, the Supreme Court ruled that “unjustified absence from the marital home for decades may be considered as part of the totality of evidence that a person is psychologically incapacitated to comply with the essential obligations of marriage.”

In this case, the Supreme Court nullified the parties’ marriage taking into consideration the husband’s infidelity, his failure to give support to his wife and children, and his unjustified absence from his family – indications that he is not cognizant of the duties and responsibilities of a husband and a father.

In conclusion, their marriage was declared as VOID on the ground of psychological incapacity.
